Well my disappointment with this particular vendor may have been resolved. I have received an email from them:
Hi Jason,
Sorry for the late reply I have been away for a week, please return the device back to us and we will send you a replacement. our return address is on our home page. please also add your order number with the parcel.

Can't say fairer than that of course when all is resolved and I have the new unit I will update again. I wasn't prepared to name the vendor in the open forum until I had taken this as far as I reasonably could and that still stands until a resolution is reached.
