Legal Advisory and Revised Terms of Forum Use As many of our customers are aware, Totally Wicked has filed a lawsuit against the United States Food and Drug Administration over the detention of a shipment of our product and the misclassification of our products by the FDA. As part of our efforts to ensure an uninterrupted supply of Totally Wicked products in the United States in the future, effective immediately, the following new terms and conditions of use of the Forum are in effect: No third-party banners are permitted; such banners will be removed. . No statements that reasonably may be interpreted as making a therapeutic or "smoking cessation" claim regarding the use of TWI's products, or electronic cigarettes generally, are permitted. Such statements will be subject to immediate editing and/or removal. Examples of such statements include statements that electronic cigarettes have helped an individual "quit" smoking traditional cigarettes, have helped reduce nicotine cravings or withdrawal symptoms, or have proven a successful alternative to approved smoking cessation drugs, such as nicotine patches or gums. There are a hell of a lot of posts suddenly gone! Whatever happened to freedom of speech?

I think it will make their forum unworkable but I can understand why TW have had to do this. The FDA woll be going through everything they say & do with a fine tooth comb

Unfortunately the use of Google makes removing posts a pretty useless exercise as cached topics remain accessable for a long time.

That is true about Google, but their site and forum will be "clean" to scrutiny.........as they are under a magnifying glass right now !

The point of TW's action is the "generally perceived as" clauses both the FDA and MHRA have in their "this makes it a medicine" armoury.
However, as I understand it, if it gets to court, it's the general perception at the time. So, if all forums follow suit, and we can get the idiot vendors who are still flogging "quit" kit to stop being toerags, then it's possible that the "general perception" of e-cigs can be shown to be that they are an alternative way of smoking, and not a way of quitting.
Leaving aside the emotive "smoking" word for the moment, this is quite an important step - changing the perception of the masses about what these things are. that's the point - if the general public see them as an alternative way of continuing their habit but with a much reduced risk, then great - and my feeling is that, although BAT will be seeking an MA, they'll sell 'em as being exactly as I've described above - the closest thing to smoking you can get without lighting a ciggy and chancing caner and death.

If I get asked "have you packed in smoking" my usual answer is along the lines of "nah... just changed me brand to one that won't kill me - all of the joys, none of the death". Usually prompts a "gizzago" response...

Nice explanation hifistud. Have to admit I was angry, because I thought how dare someone tell me what to say or not, but having understood what it's about helps. Treading on egg shells comes to mind
