A guide for businesses on distance selling. www.oft.gov.uk/shared_oft/business_leaflets/general/oft698.pdfCan I charge the consumer the cost of insuring items that I send out? 3.20 No. These items belong to you until they have been accepted by your consumer. So you cannot charge your consumers for carrying risks that you should bear. See paragraph 3.36 for more information. 3.36 Where goods are lost in transit from you to the consumer you will need to either send new goods or offer the consumer a full refund, including delivery charges. See paragraph 3.20 for more information. The Sale of Goods Act .... www.oft.gov.uk/business-advice/treating-customers-fairly/sogahome/

Even though some sellers (not just e-cigs) do post up unlawful terms and conditions on their sites, I've never had a problem getting replacements for items lost in transit. Perhaps some think customers will take the 'terms' to heart and not bother to challenge them. Some shops still post notices saying that sale goods cannot be returned - nonsense of course and trading standards are pleased to receive reports of traders behaving in this way. Many items on eBay are accompanied by a notice that no returns will be accepted. Mostly the latter are from private sellers and are more difficult to argue as 'auctions' have different rules but are by no means impossible. Best advice is if you're concerned about the way any seller conducts business, find another. Know your rights! Fox
