Hi Storm, While I don't think you can be had over any current 'smoking legislation' there are still employment contracts, and how you behave on company premises, which I presume their van falls within. I work for a national company that did at first allow it, but now, because of the perception from others, do not. Not much you can do I think, apart from twatting the apprentice! and watching your back! As I stated in my first post I have used my e-cig with the knowledge of the company directors and manager , also whilst in the same vehicle as each of them Like I said, my company changed position quite quickly, so don't take anything for granted. Bosses need to keep their paycheck as well. Not saying it's right

What pi***s me off is we are a family company , 2 engineers 2 appys and the rest are family / owners , everything is usually dealt with in an informal way .... How to lose a good engineer in 1 easy lesson = piss him off >

Take a printout of the Legal Government definition of smoking (ie lit tobacco) and tell them it is nothing for them to worry about.

Wasn't there a quote recently from a government minister confirming that ecigs don't come under the legislation? I think it was in response to a question in the house of commons. That could be quite good to show them. I wish I could remember where I saw it. Anyone else remember?

good luck storm ...my boss lets me vape in the van and office and i converted him today hopefully...give the little shit 3 months of cleaning filters and drain pans that is what i did to our apprentice for some reason he did not make it to 3 months and with the cold weather coming up put him on the roof while you work in nice warm offices.

I'd say that the apprentice needs to make sure that the back wheels are going round safely at 70mph, a gentle shove should do the rest Honestly the ignorance of some people really gets my goat sometimes. It's down to us to educate people.

Storm, there's a couple of things of note here. Firstly is the legal definition, which you now have. Secondly is whether your contract specifically bans the use of e-cigs on company premises (which under the legislation includes vehicles). Thirdly is 'custom and practice' and from what you say it has been custom and practice to allow you to use it.
My first question to them would be to ask them to lay out, precisely and in writing, what rule or code you have broken because if they can't do that there is nothing to discipline you against.

Yeah storm, even though you have broken no rules up till now, the coy can and no doubt will, make a policy of, no vapeing on company property. When i was smoking i used to smoke in the van every day, even when i had an apprentice with me, which wasn't often, they'd prefer to use them as cheaper labour fitting boilers rather than them learn anything, hence the junior one failing his gas qual for the third time on the trot ??? Any how i took down the no smoking sticker we all had to stick in the vans, and now vape between jobs on the LT, same here if they don't like it, bye bye.
