I still don't think that naming and shaming and posting on his Facebook page was a good idea, it gives him far to long to change things and also he new full well what he was doing.
@yinyang , he is still misleading the customer into thinking their getting something their not and especially by saying it was genuine. As someone else has pointed out, other pictures on his page are wrong to, which leads me to believe that his whole B & M shop is filled with cheap knock offs claiming to be something their not.Certainly somewhere I won't be buying from.Also when products are like that they probably don't have the proper safety features and could be dangerous, not really any better than buying off a market stall.
I was really after opinions and was quite willing for people to make up their own minds where it was and let trading standards investigate their advertising and claims.

That is the point I was making earlier hijack ... unless it is described as a SvoeMesto Kayfun 3.1 he is not breaking any laws by selling a genuine Kayfun 3.1 which can be a genuine Tobeco or Ephro or Ecigar Kayfun 3.1

yes I agree, with the exception that any kayfun being sold in this country with SvoeMesto or their trademark stamped on it, would be liable to be confiscated as being a fake by trading standards.

Trading standards wouldn't have done anything as it wasn't advertised as a svoemesto kayfun, clever wording to deceive potential buyers.. naming and shaming WAS the right way, as was giving him chance for some honesty (ie. Changing the description) The svd looks like an advertising sticker. Afaik, you can't buy clone svds..

First I never defended the vendor, I just wanted opinions of what you guys would do
Registered trademarks in the EU like Kayfun IS , is a matter for trading standards , sent email to Svoemesto
Until I mentioned it , how long did the vendor think he was going to get away with TRYING to sell something under false pretences ? That's just one product, how many other products that he's selling are clones too ??
As mentioned on other forums there are SVD clones out there, especially from the Chinese This is no disrespect to the Chinese , as their culture is one where if you copy something, even if it really poor, it's supposed to be a compliment.It was either last year or the year before where there was a shop in CHINA itself that for all purposes was a Apple Istore , it was found out after several complaints of bad products that it wasn't at all , NONE of the staff working there knew either.The store was closed by the government if I remember correctly.
I mean no offence by the remarks above.

I don't think kayfun is a registered trade mark it is Svoemesto that is trade mark, and any kayfun that has that trade mark if it is a clone can be taken by TS. As most of the Chinese clones have the Svoemesto trade mark then that applies to all of them even the ones being sold as clones.

What I would do? Just tell the vendor it's not a genuine kayfun but a clone of it, educate him gently on clones etc. Some people may not be aware , and with folks jumping on the ecig 'boom' it may get 'worse' .
So tell him, ensure he understands , that way he can gain knowledge and inform customers next time. It's all about sharing the knowledge , making it a better world for vapers.

Ok. First things first, svoemesto and cloud 9 vaping were made aware of this yesterday. They were grateful for the link but won't take things any further. The word "kayfun" isn't trademarked. Thus why clone manufacturers have been been to get away with calling their copies "kayfun 3.1 or lite". bet Svoemesto are kicking themselves lol As I said before, he will not get chased by trading standards.. Their description, whether it was intentional or not, has been changed. He is also selling them as clones now. regarding svd clones. Can you direct me to the forums that have the evidence to back it up? Saying these things without absolute certainty is in theory slander... whether you like it or not, chinese manufacturers are here to stay amd some of the products they are making are just as good as the products they're copying.. in some instances, some manufacturers are going straight to china for manufacturing. . Expromizer is one example..
