Lets face it the law is an ass. I remember when the anti-smoking law came in and was amazed as I stood in a metal and concrete stand (so no fire issues) at a football ground with the wind nearly lifting me off my feet to be told that it was considered an enclosed area and as such smoking was banned.

Think the lady may have been confused. There are no laws on vaping in public spaces in Scotland (yet). While the law on smoking in public spaces does apply to bus shelters, until such a law referring specifically to vaping comes into force (if it ever does), I wouldn't worry about a fine. Private companies can set their own policy on vaping, but this isn't legally binding and you certainly couldn't be fined for breaking their rules. Possibly could end up with a fine on railway property, if it has been included in their bye-laws, which I don't think it has YET

Not sure if this is correct but I think to be an enclosed area it has to have at least 3 sides and a roof, a few non-league football grounds ban smoking anyway, and I think all league grounds are No Smoking The one that always makes me laugh is the railway, little station in the middle of nowhere, no shelter and yet it is officially a no-smoking platform - WHY and who the hell is going to enforce it?
