Just after a bit of advice really.
I have a smok M80, it's less then three months old. Tonight I took my lemo 2 off, rewicked, put it back on and it said 'check atomiser', now it say's that no matter what I do. I wouldn't mind if I had ragged it around or misused it but I havent, I use one tank with it, a lemo 2, and it only comes off when I have to rewick or rebuild it. Its never left the house, or been dropped or knocked over. I've babied it. To say I'm gutted is an understatement.
I emailed the vendor and am awaiting reply, but digging around their site it says items come with a 28 day warranty. Now last I checked, a website stating that doesn't trump the sale of goods act.
But then I could be entirely wrong and I don't want to go in all guns blazing when they send the inevitable 'sorry but it's a 28 day warranty' reply. So, am I right? Is it a-okay for them to say 28 days and I should bin it and move on, or should I peruse it, because as far as I'm concerned screwing a tank on shouldn't break a mod that's less than three months old.
I paid with paypal so could always go that route if the vendor days no but I don't want to be 'that' customer kicking off when I'm on the wrong on this.
So, if they do say 'sorry, it's not covered', do I try to claim via paypal (if possible)? Or do I just accept that and move on?

Often a vendor might have a short warranty but the item is still covered by the manufacturer, the 28 days is where you can take it back and get a straight replacement but the longer warranty is where it needs to be sent back to the maker who then decide whether to repair or replace. According to the CAB website the contract is with the vendor in the UK if bought from a UK shop. So basically they can say what they like about warranties but it doesn't trump the sale of goods act. The consumer rights site says the following Your rights are with the retailer. Legally, you have a contract according to the Sale and Supply of Goods Act, and that contract is with the retailer, the person who you paid your money to, and not the manufacturer. Any rights that you have against the manufacturer, such as a warranty, are in addition to your legal rights in consumer law, and so you don’t have to rely on that. Your first port of call should always be the shop. I expect an item costing me £40 to lasts more than 3 months and not break when doing a simple thing like screwing a tank on. The tank has been taken off and put back on around once every two weeks to rewick/recoil the tank. And I don't think I'm being unreasonable to expect the mod to still be working. Obviously this may all be irrelevant as I've not heard from the retailer yet and hopefully they'll do the decent thing.

The retailer should ask you to return the item for them to look at. After testing, if its found to be faulty and there is no sign of misuse, they should send you a new replacement.

We are going through this with one of our Isticks, the guy in the shop is emailing Eleaf for us to try and get it resolved and if not he has offered to have one of his guys try and repair it for us.

very much down to the retailer on this one as i think ecig type stuffs is one of the few things not covered i know its a daft question but you have tried diff attys on it Yes. Tried every atty I own. No change. Tried resetting it. No difference.

Don't let them fob you off. Have a Google. Your contract is with the retailer and not the manufacturer. It's up to the retailer to repair/replace.

I have a feeling batteries, which includes mods, are a consumable item, so therefore not covered by the regs... I could be completely wrong though. We offer a 3 month warranty on all of our batteries, whether the manufacturer offers that or not, so it's not something I've had to research in great detail.

According to everything I've read UK law states items (besides disposable ones) comes with a one year warranty. With the vendor. Your manufacturer warranty is in addition to this. A lot of items come with rechargeable batteries. Phones. Toothbrushes. Shavers, cordless home phones. They all still come with a one year warranty in accordance with UK law. And it's not the battery that's failed it's the 510. And given I've taken the atty off and put it back on around 10 times I don't see that as excessive (the lemo is top fill so no need to remove it to fill the tank. Only when rewicking). I'll call trading standards tomorrow just to be 100% sure that I've not got it wrong. Because as I said despite now thinking I'm on the right I don't want to be that customer causing a fuss whilst being in the wrong. I don't expect vape gear to last forever. But I also don't expect something I paid £40 for to stop working in under 3 months with just normal usage.

Exactly the same thing happened to my m80 after 3 months. I got mine from myepack and I contacted them and Ash said send it back and we will fix it or replace but I couldn't be bothered so I opened it up and the wire that earths it that was soldered to the lid the soldering had snapped so it would turn on but wouldn't fire as if it was shorting out. I fixed mine by soldering it back on to the lid. Perhaps thats whats up with yours. It's an easy fix if it is.

Hopefully the vendor will offer to fix it or replace. Where did you get it from?

They had an offer on at the time that I spotted on the Facebook group.
Not heard back yet but as I said it's the weekend so I don't expect too.
After I emailed I did spot after looking about on their website it states 28 day warranty.
