GunJack , you didn't miss anything. Tis me who appears to be missing something ... seems I lost my marbles somewhere between my first and second posts above.
As per
joeten original post, the NT government is now running an inquiry to see what changes to their current Tobacco Act they might wish to perform to bring E-Cigs under that same set of laws that currently govern tobacco products in their Territory.
This is similar to what some other states have already done or are in the process of doing (New South Wales and Victoria I believe). So the comment made by
joeten about state (and territory) political and legal moves "migrating" is very valid.
My second comment suggesting that migration would be a good thing was where I clearly lost track of my marbles. *sigh* Donno what I was thinking - clearly I got my wires crossed when I posted that. Sorry.
++ Anyway - this review to the NT Tobacco act is completely aside, separate and independent from the Oz wide issue of liquid nic suitable for vaping being listed as a controlled poison at a Federal level and where the states all declare that controlled poison not allowed within their authorities.
A few extra comments about those proposed changes to the Tobacco Act. As I mentioned earlier, this sort of change has already been done elsewhere and saw much angst result. Some of the changes seen in New South Wales from like legislation changes included:
Extended the places smoking is banned - including public parks (local and state), reserves, beaches etc.
Extended the restrictions on advertising, sale, promotion of smoking. "Plain packaging", No public displays etc.
Extended all smoking restrictions to cover all things to do with E-Cigs.
So Vape shops in Sydney had to:
* Blank out their store windows - opaque, no see in from outside.
* Hide all their gear behind opaque covers. NO glass benches or open shelves with goodies on display.
* Forbid staff offering items to customers. Staff cannot offer, customer has to request. No It isn't sufficient for me, as a customer, to ask the staff member to "show me all your MTL tanks", I have to specify the exact item I want to see.
* Ban on free "juice tasting" within vape shops.
and so on. Remember, this is different and separate to the total ban on nic liquid.
Elsewhere, including E-cigs within the smoking rules did things like:
* Specifically include banning vaping in hotel/motel/short stay accomodation where smoking is banned (Remember my recent trip? Every one of those places we stayed had no smoking signs - some banning smoking anywhere in their grounds.)
* Bans Vaping in public parks and reserves, at the beach and many other local public places - same as smoking.
* Bans Vaping in state and national reserves/parks (huge tracks of parks/natural forest - like the whole National Park behind the Great Ocean Road). Smoking was banned as a fire risk in such places - bush fires is a big issue here. But Vaping? Still covered and banned. If this legislation passes Oz wide, then it'd be straight up illegal to vape anywhere in the Kosciuszko National Park - meaning all Alpine towns in that area would face a blanket ban on the use of E-cigs.
This set of proposed changes isn't good for vaping here.
