So I'm using the no brand name batteries that came with my Sigelei Zmax telescopic and I want some decent protected batteries. Are all the Torchy and Efest batteries on ebay protected or do they differ?

They'll differ. Some mods don't work with protected batteries - it is a matter of choice, not quality.

If they are protected it should say so. I thought that and some say 'protected' and some don't. Is it not the case that all IMR batteries are protected?

No, not all IMR batteries are protected. If it doesn't say they are protected then they should be unprotected. Doesn't do any harm to check with the supplier if you are concerned.
