Yep, looks like an evod. There are some evod clones about - some people have reported getting a batch of cheap ones from China some of which leaked. No particular reason to think there's anything wrong with yours, but if you think its a clone maybe put it in a plastic bag or wrap it in tissue when you put it in your pocket until you are sure of it.
You can get replacement heads for it, pretty cheap, or even buy wire & wick and rewick the old ones instead.

I was holding it while talking and leaked A LOT through the little air holes on my jeans earlier, may of been leaking in my coat but Have not noticed lots. Could it just be the way its held? guessing no. Dam things on charge now.... think I'll order a starter kit type thingy and keep this as a spare, would a variable battery be preferable or is it overkill for a newbie?

It's a matter of opinion, but I don't think a spinner or twist is overkill, but I wouldn't get anything much fancier than that as yet. Technical development is pretty fast, and if you do eventually want something with more power or features than a spinner there'll probably be better and/or cheaper devices available than there are now. And many of those of us who have more expensive stuff also have spinners for out & about.

Tried what you said and it kept dripping out so guess not a good one! still worth keeping the battery though I guess. Will the charger be ok to use with other devices? such as the ones in the links above? Ah well, worth a try. Yes, certainly keep the battery, and the charger should be fine with those.
