But buying and even just possessing illegal drugs is specifically illegal. No such laws about non-compliant tanks/e-cig kit/juices.

Actually I have just realised that from next week I may be a criminal anyway. I mix small amounts of juice for a couple of friends. One of them keeps chickens and pays me in fresh eggs. At 70 it looks like I may have become an illegal drug dealer. I have a baseball cap somewhere just need the hoody now.

Or another way to look at a private sale is i sell you a 2ml tank that was bought legal at the time of purchase I:E now that fact that it will
hold 5 ml is down to you i sold it as a 2 ml tank.

We do only approve Vendors who abide by Consumer Contract Regulations as it shows professionalism and responsibility among other things, so it would be hoped that our Vendors will be equally respectful with regards to the TPD to spare us all the awkwardness of any potential situations.

It's not something we've discussed in all honesty Tomo , the TPD fills us with as much gloom as it does everyone else.

But there it is, soon to be law and the T&C's for using Proboards do state that we also have a responsibility for ensuring laws of the land are adhered to.

This is unknown, uncharted territory so we'll take instances as when, if they do arise I would imagine.

Chrissie , snow . . . . would you have further thoughts on this?

My thoughts are that we should be lenient & I agree about taking instances as they arrive.

On TPD advertising side of things. If I or a vender themselves post a link to a great bargain from a uk vendor isn't that technically advertising? What that be against the TPD :\

Unlike with sales in the context of advertising the term used is 'in the course of a business'. So I do not see that it can apply to any of us who are not involved in a business making such comments. i.e. not technically advertising or indeed advertising at all. Again just my view; but here is the wording;

  43.—(1) No person may in the course of a business include, or procure the inclusion of, an electronic cigarette advertisement in an information society service provided to a recipient in the United Kingdom.

(2) No service provider established in the United Kingdom may in the course of a business include an electronic cigarette advertisement in an information society service provided to a recipient in an EEA State other than the United Kingdom (“a non-UK-EEA-State”).
