Would pulling out the E.U jeopardise todays decision if we ever get round to having a referendum on the E.U. The 3 main parties want to stay in but if we did decide to pull out, I fear that the Government will have the last say of the matter. It would. But see also above. In general, an EU directive compels legislation on member states, it does not prohibit it; i.e. the UK, whether in or out of the EU, can still introduce its own legislation... but there are restrictions on this due to free trade (what the EU was originally meant to protect, and which is our friend here). Tl;dr: do not vote UKIP!

The voices of reason and the power of democracy won the day today, not the flamethrower and the name-calling! QFT

I'm not convinced that nicotine solution is going to be covered in their definition of product. But I'm not convinced it's not either. After all they're legislating on e-cigarettes under the title of 'tobacco products' (i.e. something that's produced from tobacco).

I'm still a little confused why the attention on that - not passing 'Amendment 71 Proposal for a directive Article 18' would still leave in place the huge restrictions (essentially making any sensible eCig medicinal) unless those restrictions were raised from 2mg to 30mg by Amendment 170 to Article 18.
That's our real win (except for DIY).
(I get the argument now though - the latter couldn't have been accepted without throwing out first the amendment to medicalise all nicotine-containing products)

Ah, now I see what's wrong - what we should be quoting is 'Amendment 71 Proposal for a directive Article 18'

No. Once you've Godwin-ed there's no point. I tried to ask you earlier (on the BBC thread) what you think 'elite' means, but once you've cast yourself as resistance versus (literal) Nazis there's no debate to be sought.

Now the devil will be in the detail, it depends how it's implemented by the UK, if they medicinalise anything over 30mg then I'm guessing that you will need some kind of license to buy it, but all speculation ATM I know what's going to be in my freezer in 2016...

I think they'er talking about the Swedish Snus Me too. I think kibbster meant a different amendment. The press might confuse tobacco and 'nicotine-containing products', but the directive doesn't.

Can anyone clarify which amendment imposes the 30mg restriction and whether the wording means we'll face a restriction in nicotine solutions for DIY? This is the one your looking for with the ALDE amendments on the right, problem is all it does it give you the proposed outcome without explaining how it will be put into place. www.scribd.com/doc/171395066/20130927-Alde-Draft-Am-New-on-E-cigThanks again, so the wording is: "nicotine containing products with a nicotine level exceeding 30 mg/ml are not placed on the market" Whether or not we can continue to buy pharma-grade nicotine solution will now depend, as I opined last week, on the definition of 'product' (which I guess is scoped to the final version of the TPD).

if 71 had passed we wouldn't be having this discussion now. 71? 71 rewords: "The prohibition of the sale of oral tobacco should be maintained in order to prevent the introduction to the internal market of a product that is addictive, has adverse health effects and is attractive to young people." to: "Upholds the ban on tobacco products for oral use, however, such a ban should not affect historically traditional tobacco products for oral use, which may be allowed by individual Member States."

Thank you. So 169 passed? (I really couldn't work out why anyone would be excited by 170, which merely documents the existing legislation into an annex)
