Sounds to me like I always thought they are going to implement the TPD to the hilt! Only saving grace is it sounds like imports are still ok. I'm not so sure about imports from Non EU countries. Section 47 is about Cross Border sales within the EU and does not mention those from outside. That does not mean that they are permitted without registration. I think you then have to refer back to Section 31(1). That clause is an overarching clause requiring all producers and suppliers to register with the Secretary of State. That clause does not specify where the supplier is located, so unless specifically mentioned, as it does in Section 47 Distance sales in the case of other countries in the EU, producers and suppliers to the UK must comply with the above. Of course there is no compulsion to register and comply, and nothing could be done with any company such as Fasttech if they didn't, it leaves the door open to HMRC intercepting the packages as they arrive in the UK, and holding them till they register, which will be never. Not sure how Paypal would respond to a refund under those circumstances. Hopefully my interpretation is wrong, but interesting times ahead I think. I think you are right and HMRC will play a pivotal role.

After just reading through that thread I'm not surprised he left and after looking at a few other threads I see he's not the only one who's left after the fan club has gotten involved.

Have placed a lot of orders with Gearbest. Most have gone o.k without a hitch mostly the ones from the EU warehouse but quite a few from the China warehouse have been shipped late, cancelled/refunded and have had a couple not arrive at all still waiting for two orders shipped in September that haven't turned up, luckily they were for smaller items. In future I won't use their free postage option and will always purchase the added tracking number. I have been shopping online from abroad for years and Gearbest is the only place where stuff has got lost in the post. I will still shop there but one has to be patient and take the quoted ships in x days with a pinch of salt and be prepared that one might have to cancel. I have also had the offer of extra points to post positive reviews a few times so you can also take them good reviews with a pinch of salt.

Ah well looks like a bad move on my part ordering this, ordered over a week ago and still hasn't shipped when I asked them why not it seems the item is a hot sale and there have been significant supply issues with the manufacturer. Lucky for you if you got one but they want me to wait a further 15 business days. So I guess that's another 3 weeks. Bugger.
