There has to be a separate policy for e cigarettes and clearly stated in the work place handbook where everyone can see it. It can't just be classed as smoking as its not!! The company I work for had anti smoking policies in the work place. Then people started using e cigs in the canteen etc. They then changed the policy to include the use of e cigs not allowed in the workplace either boys clearly stated. Doesn't sound likes it's very clear in ur workplace. Ur union rep should be able to sort this.

You could always use the new law on smoking in cars with minors Under 18 ???
As that is law now in the uk but it doesn't affect vaping as the law makers agree vaping is not smoking!
Or the NHS u-turn on there Ecig policy
The NHS is now telling people looking to quit that:
“On current evidence they carry a fraction of the risk of smoked tobacco.” “E-cigarette use carries only around 5% of the risk of smoking.” “There is no evidence of direct harm from passive exposure to e-cigarette vapour.” “Evidence from a number of studies indicates that e-cigarettes can help people quit smoking, with similar or better results than nicotine replacement therapies such as patches or gum.” “Daily use of tank models that can be refilled with liquid may give smokers a better chance of quitting.” “E-cigarettes can help people to quit.” “Among under-18s, while experimentation with e-cigarettes is fairly common, regular use is rare and almost entirely confined to those who have already smoked.”.
I'd make yourself up a list of all the plus's for vaping with both the police saying vaping is not smoking and NHS new stance on vaping.
Don't go in and just hold your hands up as they are saying you broke smoking policy which you didn't ?
If they don't have vaping included in the company policy then you have not violated the company policy Simples !!!!!

How long have you worked there? If it's less than two years you have very limited rights and essentially they could fire you for any reason they wish anyway provided it doesn't impact on protected status is disability or sex etc etc. If it's more than 2 years I would definitely stand your ground if there is no written guidelines that you are aware of AND acknowledged (by way of signing either in training or your terms of employment) less than two years it's always best not to get employers backs up too much so although I would make my point on the above reasoning re training and awareness of policies I wouldn't be going in guns blazing.

Make sure your union rep is in the meeting, and if they can't make it, you can ask for the meeting to be postponed. If that happens get the rep to ask for the postponement, not you. Helps to show them you have rights. Don't let them bully you. Good luck with it, but you should be okay.

I would counter sue for u fair dismissal. Yes they will throw I'm some form of counter but, how does the old saying go, ignorance is bliss! If there are no direct signs or guidelines stating no vaping, you are not to know. Yes you could have asked but at the same time if it was going to become a job defining huge deal, they could have told you.

If it all goes tits up go to your local CAB they will be able to put you in contact with an employment law expert or if needed a solicitor specialising in the field.
