Thanks to jessica and vapers.org for the link, but what the f*** must this guy be vaping to have this happen?? Or, alternatively, "I've been caught, how can I get out of it??"

Maybe not some ejuice does contain alcohol and if he were vaping when pulled over his lungs might have contained a high concentration of alcohol throwing the results of the breath test off.
What sounds daft though is when you get arrested they do a further test at the station to verify the result of the roadside breath sample, all he had to do at this point was request a direct blood test be performed rather than a further breath test.
There's no way his blood volume would be over the limit if indeed the breath test result was down to vaping, then he probably wouldn't have even been charged.

He won't fall for it then. Unless the defendant's lawyer starts saying the e-cigs create infinite amounts of alcohol in the vapor, which would be a new trick for the ANTZ.

It doesn't have to create infinite amounts, go to the chemist buy 2 breath test kits and a bottle of mouthwash, swill the mouthwash around your mouth spit it out and take 1 test right away you'll fail it, take another an hour later you'll pass.
Your blood alcohol level will be zero or virtually zero you'll absorb some alcohol obviously through the skin in your mouth but not enough to be over the limit the alcohol residue in your mouth and the vapour though will be enough to throw the results of the test.
A similar effect could be caused if the guy were vaping when pulled over and the juice had alcohol in it.

I think while it's certainly possible that this guy is trying to pull a fast one though for the reason i gave before, he could have simply requested a blood alcohol level test at the station rather than blowing again on the station machine if he believed vaping was distorting the reading.

The test at the station has to be more than 30 minutes after the roadside test, and in all likelihood would not have been allowed to vape in the cells, so any vape residue would have dispersed in that time, even if he were vaping neat vodka. GUILTY AS CHARGE M'LUD.

I thought alcohol degraded when you applied heat to it, but after doing a bit of searching apparently it dosent unless you keep it heated for a long time & even then it doesnt totally disappear
