I need your opinions please as i don't know which way to turn,bearing in mind i have been fighting for 4 years,i have photo evidence and a taped conversation of the lies they told me,the fact they have done a sound test which supposedly passed,the NHBC backs them and they say they will get there lawyers involved if i take it further and i can't afford one.They have agreed to visit me to talk about a goodwill gesture but i do not know how much they will agree to. If you was in this situation what would you do please.

They obviously know they are in the wrong otherwise they would not even consider a goodwill gesture. I am sure I have asked you before but do you have any legal cover with your house insurance or car insurance or even your bank account? Are you a member of a trade union, as they sometimes offer legal advice. What sort of figure would you like? Perhaps get this thread moved to the members only section if it is not already there. Depending on the amount you would feel is fair, you could consider the small claims fast track. You only have to prove "beyond reasonable doubt" that they are at fault. You definitely need some professional advice. Give the neighbours a 2 litre bottle of water and get them to slowly tip it down the loo when the Wimpey people are there also give them 2 potatoes to drop down the loo after the water, preferably groaning a bit as they do. You could send them a pre written text when the time to do it would be right.
