They say on the letter that they have told me any work will probably NOT solve the problem and they have told me that yet i have still agreed to have it done,they have NOT told me that and if they know it won't work then they know what the problem is surely.

That letter needs to go to a solicitor for them to reply to Wimpey with the highlighted. As you say, they obviously know there is a problem, they obviously know what that problem is, why would the do the work if they know it wont work and furthermore, why would you agree to the upheaval if it won't solve the problem? - Muppets!!

Totally agree with fred what a complete load of tripe, there's no way you going to go through with the upheaval if it's not going to work. Could you not get some detailed quotes from specialist sound proofers/builders (if there is such a thing) then go back to wimpy with a counter proposal & say this is the type of work I want doing, with these materials & done to this standard with this level of guarantee. Make as idiot proof as possible cos it sounds like they need it. Throw in as much as possible then if you have to compromise you know which bits you'd be willing to sacrifice, so if you've already had something done to the ceilings you can include them but then be 'reluctantly' willing to drop them in the spirit of compromise, you could also include the cost of re-decoration but again it would be something you could reconsider. You could point out how generous your already being as you haven't even mentioned any claim for 'Emotional Distress from the persistent anxiety of living with wimpy's reckless disregard of your problems'. Not sure you'd get anywhere with a claim like that but it might give them a wobble. But just a word to the wise don't be too excessive & OTT & try including something like a complete remodeling after any work, or a brand new kitchen cos then they might just look at it & say we'er never going to satisfy this guy so sod it, then the only option will be a full blown legal claim. You just need to remember this is a negotiation & they'er starting from they'er lowest point, you need to go in with your max & hopefully you can find a point in middle where you'd be happy.

They're using a standard bait and switch tactic - obfuscating the issue, admitting then denying, offering something then saying something else. I wonder how tight things are at Wimpey Construction if they're dancing around like this over some soundproofing that they should have done right in the first place. I think it's utterly disingenuous of them to make it seem like they're doing you a favour by sorting out their crappy workmanship. Bastards, just bastards. Don't let them screw you - get help and screw them back as much as reasonably possible.

Check your household/car insurance for legal cover...I used £50k worth on my house insurance a few years ago..Well worth the money.
