Dear Mr. XXXXXX Please note that I also respond on behalf of Malcolm Harbour MEP and Anthea McIntyre MEP as I take responsibility for all constituency enquiries from your area.
Based on your correspondence I have made further enquiries and I have received the following information on this issue:
I can confirm that there are no plans to directly ban e cigarettes at an EU level. Instead e cigarettes, which are above the threshold of 2mg of nicotine, are going to be re-classified as cessation medical products rather than tobacco products and therefore they will be covered by Medical Device legislation which is also under consideration by the EU institutions rather than being encompassed with the revision of the Tobacco Products Directive that you referenced.
It should be clear that although this reclassification will not ban e-cigarettes. It will necessitate a prolonged period of research, and require many more complex certification standards to be reached in order allow sales in a number of outlets . Furthermore, since they will be viewed as medical products it is likely that they will not be as widely available in everyday retail stores and instead they will probably have restrictions to which points of sale they can appear.

No, but it'll EFFECTIVELY BAN useful e-cigarettes. Even if nicotine liquid does get some medical approval, it'll mean we become slaves to the pharmaceutical industry. (or break the law)

robdelmar I would email him back saying, would he like to Contact Martin Callanan for the latest information on e-cigarettes and ask him how he views the issue, and why he feels that way? It would be better for him to hear it from a fellow conservative, rather than us bombarding him and just ignoring it.

I would also make him aware of the 5 times electronic cigarettes have been classed as medicinal products that the courts in each EU country have over turned the decision. Hence there will most certainly be a legal challenge on such a decision.
As well I would ask for his justification for voting for such a proposal when current evidence regarding electronic cigarettes shows them to be at least 90% less harmful than normal tobacco cigarettes which will still be available on the open market and free from some restrictions.
I would end by asking would his decision be based on health or financial concerns (i.e tax revenue etc).

But I would rather post him Martin Callanan's email, and maybe Cc Martin you could also add Martins email to that email. I doubt if he is that far out of touch will want to know, but sending him links to studies won't help IMO.
