I am currently working on a NEW Page For Web site Ref: Oct 1 2015 Age checker for online sales of tobacco produces. Forum members input regarding documents that might act as proof of age or wording would be appreciated
The out line of the page as it stands at the moment. Min purchase Age verification - No sales Under 18
It is an offence under section 1 of the Forgery and Counterfeiting Act 1981 to make a false instrument with the intention to use it to induce a person to accept it as genuine, and by reason of so accepting it to do or not to do some act which is to their own or any other person’s prejudice.
The Prejudice in this case will be a fine off £2500 if I am to sell to Under 18s
As of 1st October 2015 UK Law requires that before we supply e-cigarettes or nicotine orders that we get proof of age (MIN AGE 18) If any order containing item listed on this website in Red please reply to the sale conformation e-mail from the web shop requesting an attachment ,a scan or high quality-digital photograph of your identity document or a scan of other documents this return e-mail to cig-eliquid.co.uk must include your order number allowing us to fill the order once your age has been established
We now require
A scan of one (1) of the following from the list below providing it clearly showing your name and age and address ( matching the order address) As this is for age checking only we will NOT be interested in your image/photo you may cover them - documents /bills can be as old as you like if they provide the information required we will except them as proof of age
Passport —- Out of date passport is fine Driving licence new or old type. National Identification card Citizenship certificate Details of Credit card activity— Utility Bill Old Tax Bill Old Copy of Bank Statement showing bill payments you may blank out any details of transactions or amounts that are of no interest to me. We can only accept Paypal account details or Debit card as proof of minimum age requirement if they prove that the Paypal account is over 5 years old and the debit card is over 10 years
As research has shown most attempts to avoid refusal involve genuine ID, but which does not belong to the person I may also need to get back in contact If you are refused /Order is declined due to age(under 18) or you simply do not supply the requested details you will be refunded in full LESS the Paypal charge for the transition this currently stands at £0.20p. The Refund less 20p Paypal fee will be made within 7 working days

Is that seriously the law that customers have to provide scans of documents and crap to buy juice and stuff? If that's the case i can see it killing people's businesses because i for one will not be going through all that nonsense to order online and i doubt many other people will either.

Seems very ott as many alcohol selling sites such as www.thedrinkshop.com only require a yes I'm legally allowed to drink and payment details.

In days gone by I have ordered tobacco and alcohol to be delivered with my groceries, but never had to send in stuff like that. I know I haven't smoked for nearly a year, but the likes of Asda and Tesco never batted an eyelid. What is different now?

This fly's in the face of a government that continually bleats on about protecting your personal identity, now they create a law that you can't buy something unless you send copies of documents containing personal details over the interweb

You have got to be kidding me? You would get none of that from me, and hence no business from me moreover I would immediately assume you were a phishing site. If you are serious then I think you have misunderstood the legislation - the producing proof of age stuff applies to B&M stores. If you wish to try and ensure you only sell to over 18's online the simplest method is to only accept payment via a credit card and do not accept paypal.

TBH if they were to try and bring in this kind of "proof" for over 18 sales online then they'd be opening a HUGE can of worms as it could not only apply to ecig sale and would have to apply to all age restricted products sold by UK companies, the way round that for buyers is simply don't buy from a UK company and the way round it for companies is base your business outside the UK. Its unworkable and would affect so many businesses and industries and be open to all kinds of very expensive legal challenges I simply cannot see them being daft enough to even try. Data protection failures carry huge penalties for individuals let alone companies so those companies will simply stop selling anything with an age restriction, can you imagine the impact that would have on the economy?

Looks like that is going to happen 1st Oct 15 Children and Families Act 2014 The Children and Families Act 2014 (C&F) has a number of provisions for the Government to regulate to better protect the health of children. 3 These include: Age of sale for nicotine products: (C&F: Part 5, section 92) (1st Oct 2015) The Children and Families Act creates a provision for the Secretary of State to make regulations on the sale of nicotine products (such as electronic cigarettes) to children and young people under the age of 18. The regulations relate to ‘nicotine inhaling products’ which include the inhaling device, nicotine cartridge or nicotine refill substance.The regulations exempt licensed nicotine replacement therapy (NRT) including electronic cigarette devices that are licensed as medicines or medical devices.
