1.0 Introduction
Hello and welcome to my in depth guide into the incoming TDP Regulations in the UK. I will be splitting this guide up into releventing sections and hopefully showing how the TDP will effect the average customer when it is implemented. This will be quiet a long guide and indepth, so feel free to skip to the relevent sections which you're concerned about or to the summary section at the bottom.
I will not be covering the registration process as im sure most businesses will be doing there own research on what they need to do and isnt really relevent to the end consumer except for the cost being passed on.
2.0 Terminology
This section will provide you with what terms and words they will be using in the document and what they mean.
“electronic cigarette” means a product that—
(a) can be used for the consumption of nicotine-containing vapour via a mouth piece, or any component of that product, including a cartridge, a tank and the device without cartridge or tank (regardless of whether the product is dispo sable or refillable by means of a refill container and a tank, or rechargeable with single u se cartridges); and
(b) is not a medicinal product or medical device;
According to this, any part of a device which can in theory be used as a electrontic cigarette will fall under the TDP and its regulations regarding electronic cigarettes. Its interesting to note that it includes any component of the product, so the coils will fall under this definition. Some people have been stating that as mods are like flashlights, people could sell them as flash lights to get around the TDP regulations but this is obviously not the case.
“refill container” means a receptacle that—
(a) contains a nicotine-containing liquid, which can be used to refill an electronic cigarette; and
(b) is not a medicinal product or medical device;
For the purposes of this document, a refill container is the bottle e-liquid comes in. This part is open to interretation but base nicotine could in theory be used to refill an electronic cigarette and may fall under this definition. We will need further clarfication on wither it does or not but at the moment, it is unclear.
“related product” means a herbal product for smokin g, an electronic cigarette or a refill container;
This is relevent for when they are talking about normal cigarettes in the document but include the words 'related product' as it means it also is talking about electronic cigarettes.
3.0 Batteries/Mods
I've been informed by /u/hapticsquid that batteries/mods will not need to be registered, only tanks/eliquid. So there are no new regulations regarding tanks/batteries. You do not need to stockpile these as nothing will change.
4.0 Tanks
Theres 2 new regulations coming in regarding tanks (besides the registration process):
(3) The capacity of the tank of a refillable electronic cigarette must not exceed 2 millilitres.
The maximum size for tanks will be 2ml for all products registered once the TDP comes in. This means, that after the grace period is over (for older products), any tank for sale in the UK will be 2ml with no exceptions.
(8) An electronic cigarette or refill container must have a mechanism for ensuring re-filling without leakage (unless it is a disposable electronic cigarette).
10) For the purposes of paragraph (8), a product has a mechanism for ensuring re-filling without leakage if the mechanism—
(a) entails—
(i) the use of a refill container possessing a securely attached nozzle at least 9 millimetres long which is narrower than, and slots comfortably into, the opening of the tank of the electronic cigarette, and
(ii) in the case of refill containers, a flow control mechanism that emits no more than 20 drops of refill liquid per minute when placed vertically and subjected only to atmospheric pressure at a temperature between 15 and 25 degrees Celsius; or
(b) operates by means of a docking system which only releases refill liquids into the tank of an electronic cigarette when the electronic cigarette and refill container are connected.
All tanks must have a method of allowing leak free filling. This doesnt actually include tanks that much but more the bottles which e-liquid is supplied in and will be covered there. A Tank now just needs to have a hole which is bigger than the nozzle supplied on bottles and allows it to fit comfortably inside the tank. Most top-fill tanks already have this mechanism (or close), so not much will change. It is entirely possible that the tradition bottom fill method will not be allowed anymore.
(7) An electronic cigarette or refill container must be
(a) child-resistant and tamper-evident; and
(b) protected against breakage and leakage.
Ive included it here but im unsure on what this means regarding tanks or batteries as it clearly states that they need to be child resistant. This could indicate that all tanks have a locking mechanism on them to make them child proof or it could be that batteries need a locking mechanism built in to stop a child accidently firing it.
5.0 E-Liquid
As covered in the previous section, all E-liquid bottles must now have a nozzle which at least 9mm long and only allows 20 drops of liquid per minute out.
(2) Nicotine-containing liquid which is presented for retail sale must be in—
(a)a dedicated refill container in a volume not exceeding 10 millilitres; or
(b) a disposable electronic cigarette, a single use cartridge, or a tank, in a volume not exceeding 2 millilitres.
All E-liquid sold in the UK must now be in 10ml bottles at maximum. So we will no longer see 30, 50ml, or 100ml bottles of e-liquid for sale in the UK after the initial grace period of the TDP is over.
(4)Nicotine-containing liquid which is presented for retail sale in an electronic cigarette or refill container must not contain nicotine in excess of 20 milligrams per millilitre.
The maximum amount of nicotine inside e-liquids is now set at 20ml. So expect 18mg to be the maximum available to buy once the TDP grace period has ended.
Anyone running a business, again this restriction does not include your nicotine you purchase to make e-liquid as this is only for sales of nicotine to the general public.
(7) An electronic cigarette or refill container must be
(a) child-resistant and tamper-evident; and
(b) protected against breakage and leakage.
All bottles must now be supplied in a child-resistant bottle with tamper evident packaging (that ring which is on most bottles which breaks on first open is considered enough tamper-evident packaging).
All bottles of e-liquid must now also include a leaflet displaying the use/storage of the product, a warning for at risk groups, possible adverse effects, details on how to contact the manufactuer. They must also include: a list of ingrediants, nicotine content and delivery per dose, batch number, a recommendation to keep out of reach of children and a big warning sign on the label,
6.0 DIY E-Liquid
This is the bad one lads and ladies
(2) Nicotine-containing liquid which is presented for retail sale must be in—
(a)a dedicated refill container in a volume not exceeding 10 millilitres; or
(b) a disposable electronic cigarette, a single use cartridge, or a tank, in a volume not exceeding 2 millilitres.
Any nicotine-containing liquid to the general public will only be available in 10ml bottles. You cannot personally buy nicotine in bottles over 10ml once the TDP comes into force.
also, note that it has to be sold in a what is defined in the document as a refill container which means it falls under this:
(4)Nicotine-containing liquid which is presented for retail sale in an electronic cigarette or refill container must not contain nicotine in excess of 20 milligrams per millilitre.
you maximum strength of nicotine you can personally buy is 20mg.
The only positive side is that this puts the law and punishment in the side of the store selling it, so if you can find a store which is offering to sell to you, you can purchase it without you facing any consequences. There may be a way around it when they don't present it for retail sale but rather for business to business sales and you need to make up a business name to purchase it but i don't think many companies would be willing to face to prosecution and the ones which do, would you want to source you nicotine from a dodgy company?
7.0 Vapefests
(2) In this regulation “electronic cigarette sponsorship” means any form of public or private contribution to any event, activity or individual, with the aim or direct or indirect effect of promoting an electronic cigarette or refill container.
It does look like they will no longer be allowed to go ahead once the TDP hits or they will be drastically changed from what we see today. They cannot contribute to any vape fest event, so that means they cannot pay to be there and if go by the letter of the law, they cannot have a stand at the event or provide free items as giveaways as that is contributing to it.
8.0 Reddit Giveaways and discounts
(2) In this regulation “electronic cigarette sponsorship” means any form of public or private contribution to any event, activity or individual, with the aim or direct or indirect effect of promoting an electronic cigarette or refill container.
This is the question, does a reddit giveaway come under the term event or activity? If it does then they will not be allowed to give away free products or discount codes; I'd argue that it does and they will be banned.
9.0 Reviewers
(2) In this regulation “electronic cigarette sponsorship” means any form of public or private contribution to any event, activity or individual, with the aim or direct or indirect effect of promoting an electronic cigarette or refill container.
This is a bit of good news or bad news depending on your view on people recieving free goods or money for reviews of e-liquid or hardware. Companies will no longer be able to give away free items or discount codes to individuals in an effort to promote ecigs/eliquids. So any reviewers in the UK once the TDP hits will have to purchase there own products to review.
9.0 Cross Border Sales
Basically, if anyone outside the UK wants to sell to the UK, they need to register with the state and have a representative in the UK. Fasttech sales will highly likely be illegal as they won't comply but it is them breaking the law not you, so you will not recieve any punishment if customs catches your item except for losing the item. however, customs may become more aggressive on looking for small packages from china if a large portion of people choose to continue to buy products from them.
10.0 Summary
Nothings really changing on the battery/mod side of things. Tanks will now be 2ml max with most likely a top fill system.
E-Liquid will be in 10ml child/tamper proof bottles with a maximum of 20mg nicotine and a leaflet with various warnings/information inside.
DIY e-liquid is being killed with a restriction on nicotine to 10ml bottles and max 20mg to members of the public (Businesses can buy at the previous rate).
Vapefests are likely to not continue due to no more sponsorship or any contributions from e-liquid/hardware companies including setting up a booth. Reddit Giveaways may be a thing of the past.
Reviewers will not be able to recieve free items or discount codes in order to do a review, they will have to purchase there own juice/hardware.
Fasttech may become more risky to buy from.
